    From colonial rule to a Republic: Why India became a republic three years after Independence

    India became independent from British rule on 15 August 1947, but it did not become a republic on that day. For nearly two and a half years, the newly independent country continued with a transitional constitutional arrangement. India became a Republic on 26 January 1950, when the Constitution came into force and replaced the colonial-era constitutional framework.The distinction is important. Independence ended British colonial rule, while becoming a republic established a new constitutional order in which sovereignty rested with the people of India.     What is the difference between Independence and a Republic?

    The two terms are often used interchangeably in popular discussions, but they refer to different developments.Independence means freedom from external political control. India achieved this on 15 August 1947, when British rule formally ended under the Indian Independence Act, 1947.A Republic, in constitutional terms, means that the head of state is not a hereditary monarch. In India, the President is the constitutional head of the Union and is elected according to the Constitution.India’s transition can therefore be understood in two stages:

    The Constitution itself specifies in Article 394 that most of its provisions would come into force on 26 January 1950.

    Why did India not become a Republic immediately in 1947?

    The transition from colonial rule to constitutional self-government could not happen overnight.When the British Parliament passed the Indian Independence Act, 1947, India became an independent Dominion within the Commonwealth. The Act provided the immediate legal framework for the transfer of power.This meant that although India was no longer under British colonial rule, the country did not yet have its own fully operational Constitution.The Government of India Act, 1935, suitably adapted for the post-Independence period, continued to provide the basic legal framework until the new Constitution came into force. The Law Commission notes that India functioned as a Dominion between 1947 and 1950, with legislative powers exercised under the adapted 1935 framework.This was a transitional arrangement, not a continuation of colonial rule.The Constituent Assembly was simultaneously working on a permanent Constitution for independent India.

    The Constituent Assembly and the making of the Constitution

    The Constituent Assembly first met on 9 December 1946, before Independence. After the creation of Pakistan, its composition changed, and the Assembly became the principal body responsible for framing the Constitution of independent India.The Assembly debated some of the most fundamental questions facing the new nation:

    • What kind of political system should India have?
    • What rights should citizens enjoy?
    • How should powers be divided between the Union and states?
    • How should minorities and disadvantaged communities be protected?
    • What should be the relationship between the legislature, executive and judiciary?
    • How should India maintain unity while accommodating its enormous diversity?

    The Drafting Committee, chaired by Dr B.R. Ambedkar, was constituted on 29 August 1947.The Constitution was ultimately adopted on 26 November 1949 after extensive deliberations. However, it was not brought into force immediately. Most of its provisions came into operation on 26 January 1950.

    Choice of January 26

    On 26 January 1930, the Indian National Congress observed Purna Swaraj Day, following the Lahore Congress resolution of December 1929 that declared complete independence as the national goal.At the time, the nationalist movement was rejecting the idea that India should merely receive Dominion status within the British Empire.When the Constitution was finally brought into force two decades later, the leaders of independent India chose 26 January to preserve this historical connection with the freedom struggle.Thus, the Republic did not simply acquire a new date of celebration. It connected the constitutional birth of India with the earlier political demand for complete independence. The government has also highlighted this link in its account of the making of the Republic.

    What changed on 26 January 1950?

    The transformation went beyond changing the country’s name from the Dominion of India to the Republic of India.1. The Constitution became the supreme governing frameworkThe Constitution replaced the Government of India Act, 1935 as the fundamental framework of governance.The new system established constitutional limits on government power and laid down the structure of the Union, states, judiciary and legislatures.2. Sovereignty was placed with the peopleThe Preamble begins with the words “We, the People of India”.This represented a fundamental departure from colonial governance. Political authority was no longer derived from the British Crown but from the constitutional order created by the people of India through their Constituent Assembly.3. India acquired an elected head of stateUnder the Dominion arrangement, the Governor-General represented the Crown.With the Republic, the office of President of India became the constitutional head of state.Dr. Rajendra Prasad, who had been President of the Constituent Assembly, became India’s first President on 26 January 1950.4. Parliamentary democracy was establishedThe Constitution established a parliamentary form of government, with the executive responsible to the legislature.This created the institutional framework through which elected representatives would exercise political power.5. Fundamental rights and constitutional safeguards came into operationThe Constitution provided citizens with Fundamental Rights and established safeguards for equality, liberty and protection against arbitrary state action.It also incorporated the Directive Principles of State Policy, setting out broader objectives for social and economic governance.

    Why did India choose a Republic instead of retaining the monarchy?

    The decision reflected the political experience of the freedom movement.India had fought against colonial sovereignty for decades. Retaining the British monarch as India’s head of state would have been inconsistent with the broader objective of establishing an independent constitutional order based on popular sovereignty.A republic also meant that the head of state would derive authority from the constitutional system rather than hereditary succession.This did not mean India rejected all institutional arrangements inherited from Britain. The Constitution retained and adapted several features of the parliamentary system, rule of law and administrative structures.The key distinction was that these institutions were now placed within an Indian constitutional framework.

    What happened to the Governor-General?

    The office of Governor-General continued during the Dominion period.Lord Mountbatten served as the first Governor-General of independent India until June 1948. He was succeeded by C. Rajagopalachari, who became the first and only Indian Governor-General.Rajagopalachari held the office until India became a Republic in January 1950.The office of Governor-General was then replaced by the constitutional office of the President of India.This transition illustrates the broader movement from a Dominion framework to a republican constitutional system.
