A New York woman’s attempt to secure her daughter’s lifelong rights to a family property has ended in a court ruling nearly four decades after the original transfer. In 1987, Mary Mangiaracina transferred a property in Ridgewood, Queens, to another person but included a condition intended to protect her own right, as well as her daughter’s, to use the property for life. However, on April 1, a New York appeals court ruled that the daughter had never legally received that right.Mary’s daughter, Anna Marie Mangiarcina, went to court in 2023 after the property was sold to new owners. According to the case information published on Justia, Anna Marie Mangiarcina argued that the document signed by her mother in 1987 had given her a lifetime interest in the property. The new owners disagreed. At the centre of the disagreement was a legal arrangement known as a life estate which allows someone to continue using or living in a property for the rest of their life, even when the property belongs to another person. But the judges found a problem with how the arrangement had been made. The court also rejected her separate argument that she had become the owner because of her use of the property over the years.

What happened to the Queens property in 1987?

The dispute began with a property transfer on September 28, 1987. Mary transferred the Ridgewood property to Joseph C. Murania but attempted to keep lifetime rights for herself and Anna Marie.Mary died in May 2017. More than five years later, on September 9, 2022, the property was sold by a trust created under Murania’s will to new owners. The sale was followed by a legal dispute. In January 2023, Anna Marie approached the court, arguing that her mother’s agreement still protected her rights. She wanted the court to recognise that she had a life estate in the property. She also sought financial compensation based on that claim. The new owners, however, maintained that she had no such right and asked the court to dismiss her case.

Why court rejected the daughter’s claim

The judges examined the document signed by Mary in 1987. They found that while she had attempted to reserve lifetime rights for herself and her daughter, the arrangement had not legally created those rights for Anna Marie. The problem was that Anna Marie was not one of the parties to whom the property had been transferred. The court described her as a “stranger to the deed”, a legal expression referring to someone who was not a party to the property transfer.Under the legal rule applied in this case, Mary could not give her daughter a valid life estate simply by including her name in the document. The judges said this remained true even if Mary had intended to protect her daughter’s interest.

    Could the daughter claim ownership?

Anna Marie also claimed that she had acquired ownership through what is legally called adverse possession. This rule can allow someone to become the legal owner of a property after possessing it for a specified period, based on certain conditions. However, the court found that Anna Marie’s earlier use of the property had been permitted. That was important because permission to use a property does not, by itself, establish ownership through adverse possession. The judges found that May 2017, when her mother died, was the earliest possible date from which her claim could be considered.By the time Anna Marie filed her case in January 2023, fewer than six years had passed. The period was shorter than the 10 years required under the rule considered by the court.

    What the appeals court ruled

The case had initially gone before a Queens County court, which in April 2024 declined to dismiss Anna Marie’s claims. The court also considered the request for an early ruling premature, leaving open the possibility of further examination of the evidence. Property owners challenged that decision before a higher court. On April 1, 2026, the appeals court ruled in their favour after finding that Anna Marie had not provided sufficient grounds to show that gathering more evidence could change the outcome.
