A New Jersey mother who once planned to leave her property equally to her four children later decided that her two sons would receive nothing. She made the change in 2016, following a breakdown in their relationship, while one of her daughters had been caring for her for years. After the woman died in 2024, the sons challenged her decision in court, claiming their sisters had influenced her. However, on Friday, a New Jersey appeals court upheld the revised will, finding insufficient evidence that the mother had been pressured into changing it.According to details of the case published by Law.com, the woman signed the will in 1996. At the time, she wanted her estate divided equally among her two sons and two daughters. She also chose one son and one daughter to handle her affairs after her death jointly. That same year, her daughter Deborah became her sole caregiver and began living in the family home. Over the following years, Deborah continued looking after her mother, while relations between the woman and her sons eventually deteriorated. The situation changed in 2015 after a family altercation. The mother’s relationship with her sons became strained, and in some periods, they reportedly had no contact. A year later, she signed another will that excluded both sons, and Deborah was also named the sole person responsible for handling the estate after her mother’s death.

A family rift, a new will and a legal challenge

The disagreement over this decision did not reach court immediately. The mother continued living for another eight years, during which questions were raised about whether someone close to her was taking advantage of her financially. In 2021, New Jersey’s Adult Protective Services Programme investigated a complaint alleging financial exploitation. The investigation did not find evidence to substantiate the allegation, and the matter was closed. When the mother died in 2024, one of her sons objected to the revised will. Both sons subsequently challenged the arrangements, questioning whether their mother had made the decision independently.Their argument focused largely on the relationships she shared with her daughters. Deborah had been her caregiver since 1996, and the mother was also close to her other daughter. The sons believed these circumstances raised doubts about whether she had acted entirely of her own choice.

Sons believe their mother was influenced

The sons argued that their mother’s dependence on Deborah for care, together with her close relationship with their other sister, should have prompted greater scrutiny of the 2016 will. They wanted the court to require their sisters to demonstrate that their mother had not been improperly influencedThe daughters rejected these claims. They maintained that there was no evidence their mother had been controlled or persuaded to change her will against her wishes. The court examined the family’s history, including the mother’s deteriorating relationship with her sons and the circumstances in which she had prepared the revised document. One important detail was that neither daughter had initiated the preparation of the 2016 will. Neither was present when their mother signed it.The court also considered whether the mother had been capable of making her own decisions at the time. No medical evidence from that period showed that her ability to understand or manage her affairs had been impaired.

Why did the court uphold the mother’s decision?

The judge who first heard the case found that the mother’s relationship with her sons had already been damaged for years before her death. The 2016 will was also consistent with decisions she made later about her estate. The court did not accept that Deborah’s role as caregiver automatically meant she had control over her mother’s financial decisions. The sons appealed, but the New Jersey Superior Court’s Appellate Division reached the same conclusion. In its October 16 ruling, the appeals court found that the brothers had failed to provide sufficient evidence that either sister had improperly influenced their mother. It also agreed that there was no basis to require the daughters to prove the absence of such influence. The judges considered the mother’s ability to manage her own affairs, the absence of evidence of pressure when the revised will was signed and the history of her relationships with her children.
