A Florida couple's marriage lasted just 249 days, but the husband was ordered to pay $2,675.87 a month in support for nine months; an appeals court has now overturned that alimony award

A Florida appeals court has overturned an order requiring a man to pay his former wife $2,675.87 per month in financial support after a marriage that lasted just 249 days. In its decision, Florida’s Fifth District Court of Appeal ruled that the trial court made a mistake by ordering nine months of temporary alimony without enough evidence to show how long the former wife would need financial help. The case, Syed Imran Ali v. Saba Shoukat, began in the Circuit Court for Marion County under Circuit Judge Jennifer Bass. After a trial, the court ended the short marriage, which had produced no children. However, the judge ordered Ali to pay Shoukat $2,675.87 each month to cover what the court called her “legitimate identifiable short-term needs” as she moved towards supporting herself.

Lack of clear evidence about financial needs

Under Section 61.08(6) of Florida law, bridge-the-gap alimony provides temporary financial help to someone moving from married life to living alone. The law allows payments for up to two years to cover valid, clearly identified short-term needs. Once ordered, these payments cannot be changed later. According to the appeals court records, Shoukat did not provide specific evidence or testimony at trial showing how long she would need financial support before she could support herself. She only said that she would have no way to support herself for the next “several months” and asked the court for a one-time payment. Because the former wife did not provide a clear timeline for her financial needs, the circuit judge looked at earlier court decisions for guidance. The judge relied in part on Murray v. Murray, a 1979 decision by Florida’s Fourth District Court of Appeal. That case involved a seven-month marriage and a four-year alimony award that the appeals court later reduced to six months. Using that case as a guide, the circuit judge ordered nine months of alimony for Shoukat, a period that roughly matched the length of the 249-day marriage.

Legal precedent cannot replace courtroom evidence

Writing for the unanimous appeals court panel, Judge Meredith S. Soud explained that earlier court decisions can help judges interpret the law, but they cannot replace actual evidence presented during a trial. “The party seeking… alimony has the burden of proving his or her need… and the other party’s ability to pay,” Judge Soud wrote, citing Section 61.08(2)(a) of the Florida Statutes. The opinion explained that anyone seeking bridge-the-gap alimony must provide clear evidence of their specific short-term needs and how long those needs are expected to last. “Shoukat’s testimony that she needs assistance for a few months is insufficient to adequately inform the trial court as to the proper amount of time to provide bridge-the-gap alimony,” Judge Soud wrote. “And while case law in Florida certainly has its place, precedent cannot substitute for that which only admitted evidence can provide.” The court said the trial judge had relied too heavily on the Murray decision. It explained that decisions about bridge-the-gap alimony must be based on the facts and evidence presented in each individual case, rather than on the outcome of an earlier case.

    Decision of the appellate court

The Fifth District Court of Appeal overturned the part of the final judgment that awarded bridge-the-gap alimony. It instructed the Marion County Circuit Court to cancel the financial award. The panel included Judges John M. Boatwright and Carrie Ann Kilbane, who agreed with the decision. The court upheld the rest of the trial court’s ruling on property division and attorney fees without providing further explanation. Attorney John N. Bogdanoff of The Carlyle Appellate Law Firm in Orlando represented Ali in the appeal before the Fifth District Court of Appeal. Public court records show that Shoukat did not appear in the appeals proceedings and did not file a response brief.
