In 2021, a Dallas home's flooring was damaged after a neighbour's frozen pipes burst; the insurer paid $4,261 but homeowners later sought $58,150 in repairs, and an October 22 court rejected the delayed claim

A federal appeals court has dismissed a lawsuit filed by Dallas homeowners who sought more than $58,000 for water damage. The court ruled that their legal action against State Farm was filed after the deadline set by their insurance policy had expired. The dispute began during severe weather in February 2021, when water pipes at a neighbouring property froze and burst. The resulting flood caused extensive damage to the floors and structure of the Dallas home. According to court documents published by the United States Court of Appeals for the Fifth Circuit on 22 October 2026, State Farm reviewed the initial claim and paid $4,261 (£3,280) in March 2021. At the time, the insurer told the homeowners they could submit additional receipts for replacement cost benefits as repairs continued. However, the homeowners waited until well after the two-year contractual deadline had passed before seeking another $58,150 in repair costs. This led to a legal dispute over insurance coverage and the deadline for filing a lawsuit.

Court confirms strict deadline on insurance disputes

The Fifth Circuit panel upheld a lower federal district court’s decision in favour of State Farm. It agreed that all claims linked to the 2021 winter freeze were filed too late under Texas law. Under the Texas Civil Practice and Remedies Code, parties to an insurance contract can agree to a shorter deadline for legal action, provided it is at least two years. State Farm’s policy included a standard two-year limit, starting from the date the legal claim first arose. The three-judge panel explained that State Farm had made its position on the initial coverage decision clear on 12 March 2021, when it processed the first payment. The court stressed that Texas law does not require an insurer to use formal legal terms or specific wording to communicate a claim decision, as long as its position is clear. Because the homeowners did not file a lawsuit within two years of that March 2021 decision, the court ruled that their claims under the insurance contract and state law had expired.

Rejection of bad faith and misrepresentation arguments

During the appeal, the homeowners argued that State Farm had not properly investigated the full extent of the water damage. They also claimed the insurer had misled them by inviting them to submit more receipts for repair work. The appeals court rejected these arguments. It explained that claims under Texas insurance law for breach of good faith and fair dealing must also be filed within two years of the date they arise. The court also said that letters or other communications inviting policyholders to submit additional repair receipts do not restart or extend the legal deadline. An extension can apply only if a formal waiver is established before the deadline expires. The panel concluded that routine letters allowing customers to provide further receipts cannot be used to bring separate fraud or misrepresentation claims to get around the usual time limits. The ruling also noted that the homeowners had declined Additional Living Expense (ALE) coverage for the 2021 incident. They chose to stay at a second property they owned while repairs were carried out on their Dallas home.

    Impact of consecutive winter storms

The court filing also showed that the same Dallas property suffered further flooding during another major winter storm in Texas in December 2022. The storm caused additional internal water pipes to burst. The homeowners reported the 2022 damage to State Farm under a separate claim number. However, their later appeal focused only on the unresolved payment dispute linked to the 2021 storm. By upholding the lower court’s decision, the Fifth Circuit found that State Farm had met its legal duties in handling the original 2021 claim. As a result, the homeowners cannot recover the remaining $58,150 they sought for repairs to their damaged floors.
