A Florida appeals court on Wednesday, upheld an earlier decision denying a young girl’s claim to a house owned by a deceased man who had named her in his will. The case involved Melissa Azrack, who gave birth to the girl in 2017, and Malcolm Dorman, who died in March 2021. Although Dorman had described himself as the child’s biological father, an earlier sperm donor agreement and a dispute over the legal status of his house complicated the claim. The appeal ultimately failed because Azrack had not challenged a separate finding about the property.According to the judgment available on Justia, Azrack and Dorman had entered into a sperm donor agreement before the girl’s birth. The agreement stated that Azrack would be the child’s only intended legal parent and that Dorman would give up any parental rights he might have. However, Dorman later described himself as the girl’s biological father, including in his will. He also left certain benefits for her and named her as a beneficiary of a trust, an arrangement through which assets can be held for another person’s benefit. After his death, Azrack claimed that he had intended one of his houses in Golden Beach, Florida, to benefit her daughter. What followed was a dispute over the child’s relationship with Dorman and whether she could claim the house. The earlier court rejected the claim for two reasons. It found that the girl had not been established as Dorman’s legal or biological daughter. It also concluded that the house did not qualify for the particular legal protection under which she was claiming it. The second finding eventually became the main reason her appeal failed.

How the dispute over the house began

Dorman owned several properties when he died in March 2021. John McDonald was appointed to manage his estate, including the properties and other assets he left behind.Azrack later approached the court on behalf of her daughter, identified in court documents as E.M.A. She wanted the court to determine the status of Dorman’s house at 443 Ocean Boulevard in Golden Beach. She argued that Dorman had intended the property to pass into a trust for the girl’s benefit. However, McDonald, representing Dorman’s estate, opposed the claim. The estate questioned whether the child could legally be treated as Dorman’s daughter. It pointed to the sperm donor agreement, under which Azrack was the only intended legal parent. The estate also maintained that Dorman was not the girl’s biological father. The trial court examined the agreement and the evidence concerning the child’s parentage. It found that Dorman had given up his legal parental rights under the agreement. The court also concluded that Azrack had not presented enough evidence to establish that he was the girl’s biological father or had otherwise legally acknowledged her as his child. But there was another problem with the claim. The court found that the Golden Beach house was not Dorman’s protected homestead. Under Florida law, this refers to a property that qualifies for certain protections concerning a person’s home. This meant that even if the girl had been recognised as Dorman’s daughter, she would still not have succeeded in claiming the house on that basis.

Why the mother lost her appeal

Azrack disagreed with the earlier court’s findings about her daughter’s relationship with Dorman. She challenged those findings and questioned how the court had considered the evidence. However, she did not challenge the separate decision concerning the house itself. That made a difference when the case reached Florida’s Third District Court of Appeal. The judges explained that the earlier ruling had been based on two separate reasons. Even if one reason was successfully challenged, the decision would remain in place because the other reason had not been disputed. In Azrack’s case, the finding that the Golden Beach house was not protected homestead property remained unchanged. Therefore, reconsidering whether Dorman was the girl’s father would not have altered the outcome of the property dispute. The appeals court consequently upheld the rejection of the claim. Importantly, it did not independently decide whether Dorman was the child’s biological father.

The case continued after the first ruling

The dispute had also led to further proceedings after the original decision.Azrack sought the removal of the judge who had heard the case, and her request was granted in May 2024. After another judge took over, she asked the court to cancel the earlier judgment or reconsider some of its findings. Both requests were rejected.Azrack then challenged those decisions before the appeals court. However, the judges found that the requests had not been made under procedures permitted for this type of case, which concerned the estate of a deceased person. As a result, that part of her appeal was dismissed.Another disagreement concerned whether the earlier judgment could apply to Azrack personally, rather than only to her role as her daughter’s representative. The appeals court found no error in this aspect of the ruling, noting that Azrack had also taken part in the case in her personal capacity. The earlier court had also found that Dorman’s estate was entitled to recover legal fees and costs. However, the appeals court said it was too early to consider whether Azrack could personally be required to pay them because no amount had yet been decided.
